DMCA

files2link.com ("we," "our," or "us") respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act ("DMCA"). As a file-sharing platform, we act as a service provider and do not monitor the contents of the files uploaded by our users. However, we will respond promptly to claims of copyright infringement reported to our Designated Copyright Agent.

1. Notice of Infringement (Takedown Request)

If you are a copyright owner or an authorized agent thereof, and you believe that any file hosted on files2link.com infringes upon your copyrights, you may submit a takedown notification pursuant to the DMCA.

To be effective, your notification must be in writing and include the following information:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  2. Identification of the Original Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on files2link.com are covered by a single notification, a representative list of such works.

  3. Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. You must provide exact URL(s) to the specific files on files2link.com. General site links are not sufficient.

  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.

  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. Accuracy and Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid and complete notice, we will remove or disable access to the infringing material and take reasonable steps to notify the user who uploaded the content.

2. Counter-Notice (Restoration Request)

If you believe that your uploaded file was removed (or access to it was disabled) by mistake or misidentification, you may submit a counter-notice to our Designated Copyright Agent.

To be effective, a counter-notice must be a written communication that includes the following:

  1. Physical or Electronic Signature: Your physical or electronic signature.

  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the exact URL at which the material appeared before it was removed or disabled.

  3. Perjury Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

  4. Contact Information and Consent: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which files2link.com may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

If a valid counter-notice is received, we may send a copy of it to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, the removed material may be replaced, or access to it restored, in 10 to 14 business days after receipt of the counter-notice, at our sole discretion.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, files2link.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
